AUTO-GENERATED ORDERS

PRELIMINARY CONFERENCE ORDER. A Preliminary Conference Order will be automatically

generated upon the filing of a Request for Judicial Intervention and a Request for a Preliminary Conference. No

further action will be required of the parties for the automatically generated Preliminary Conference Orders to be

filed.

Please click the link for more information regarding the Preliminary Conference Part/Orders.

COMPLIANCE CONFERENCE ORDER. The Preliminary Conference Order will contain a date for a

Compliance Conference. On that date NO appearance is necessary. A Compliance Conference Order will be

automatically generated and e-filed within one week of the date. That Order will contain the Compliance part

to which your matter has been assigned. Please refrain from emailing other and multiple parts.

Rules for guidance. The following email addresses may be used to contact the assigned Compliance Part.

CSCP3 RULES

COMPLIANCE & DISCOVERY CONFERENCES

Compliance conferences are held virtually on Tuesdays and Thursdays at 10:00AM and 11:00AM via

the CSCP3 link found on the last page of the Part Rules.

EMAILING CSCP3. This email should ONLY be used: (A) to request a conference as indicated below;

(B) to request signature on a stipulation, order after conference, or Certification Order; or (C) to advise of settlement.

All emails must include the caption and index number in the subject line. Noncompliant emails and emails

addressed to more than one Part will not be reviewed.

2

WHEN A CONFERENCE SHOULD BE REQUESTED.

• Compliance conferences are scheduled at the request of the parties. Conferences should be

requested only if either (1) after good faith attempts have been made, the parties are unable to resolve an outstanding

discovery dispute, and a judicial ruling is needed; OR (2) parties are requesting the Note of Issue be extended for a

second or more time.

• If a party(ies) is requesting the Note of Issue be extended for the first time, a stipulation, which

outlines outstanding discovery and includes deadlines for the same to be completed, can be submitted. Stipulations

without a conference will only be accepted for the first Note of Issue extension. Notes of Issue will not be extended

via email or other correspondence.

HOW TO REQUEST A CONFERENCE. Email CSCP3@nycourts.gov with all parties included on the

email request. The email MUST briefly indicate (i) the dispute to be addressed; and (ii) when the attorneys last

spoke in an attempt to resolve the dispute. Upon receipt, the matter will be scheduled for the next available

conference date unless a need for expediency is noted. A pending Note of Issue date alone does not constitute

expediency as extensions of the Note of Issue date will be addressed at any scheduled conference. Failure to comply

herewith will delay the scheduling of a conference.

FORMAT.

• The calendar is called and cases are conferenced as ready. A second call immediately follows the

first call.

• There shall be no adjournments of the conferences. Parties with knowledge of the outstanding

discovery and discovery disputes are expected to appear.

• In all circumstances, the parties shall proceed with discovery pending conference to the extent

they can do so. Every effort should be made to comply with all discovery deadlines and dates set by the court,

especially the Note of Issue date.

• If the parties intend to refer to specific demands and/or responses in conference, same should be

e-filed prior to the conference for easy reference by the Court.

SUBMITTING DOCUMENTS TO BE SO-ORDERED/SIGNED.

• Documents must be emailed to the Court at CSCP3@nycourts.gov, not e-filed.

• Stipulations and proposed orders (submitted at the court’s direction) must be sent within two (2)

weeks of the conference date. Failure to do so will result in the parties being required to appear in-person to

submit the stipulation or proposed order for review and signature.

• Documents must be clearly signed by parties and indicate the signatories, and they must not have

a signature only page—meaning a page which only contains signatures/signature blocks. The page where parties

sign and where the parties request the Judge to sign must contain at least one item of discovery.

CERTIFICATION ORDERS. If a Note of Issue date has been assigned, parties may, but are not required

to submit a Certification Order. If parties elect to submit a Certification Order, it should be emailed in accordance

with the above.

DISCOVERY MOTIONS. Motions regarding discovery disputes should NOT be made unless the matter

has been released from the compliance part for such purposes. Matters will not be released via email without a

conference.

3

SUBPOENAS. Subpoenas may only be submitted to CSCP3 if an IA judge has not been assigned,

otherwise the subpoena should be submitted to the IA judge. Requests to have a subpoena signed should be

accompanied by an affidavit in support of the request and emailed to CSCP3@nycourts.gov.

DORMANT MATTERS – THIRD WEDNESDAY CALENDAR

On matters that have been dormant, an order will be issued scheduling the matter for a virtual conference.

Generally, these conferences are held virtually on the third Wednesday of every month at 10:00AM and

2:15PM. The above relevant Compliance & Discovery Conferences rules apply. Failure to appear may result in

dismissal without prejudice. If your matter has been dismissed in this manner, contact CSCP3 via email before

filing a motion to vacate.

FINAL NOTE OF ISSUE – FIRST MONDAY P.M. – CALENDAR

On matters where the Note of Issue was marked final, and that final date passed without the Note’s filing,

an order may be issued scheduling the matter for an IN-PERSON conference. Generally, these conferences are

held on the first Monday (or in the event the first Monday is a holiday, the following Monday) of every month

at 2:15PM in Courtroom 42. The above relevant Compliance & Discovery Conferences rules apply. Failure to

appear may result in dismissal without prejudice. If your matter has been dismissed in this manner, contact

CSCP3 via email before filing a motion to vacate.

Rules for in-person calendar appearances may be posted outside the courtroom. Please check them before

making an appearance.

SETTLEMENT CONFERENCES

Settlement conferences are scheduled at the request of the parties. They are typically held in-person on

Mondays at 11:00AM. To request a conference, email CSCP3@nycourts.gov with all parties included on the

email request. The Court will provide its availability for such a conference.

PART 16 RULES

MOTIONS, OSCs, EMERGENCY and EX PARTE APPLICATIONS

All applications, motions, and orders to show cause shall be returnable and heard IN-PERSON on

Mondays at 10:00 a.m. Rules for in-person appearances may be posted outside the courtroom, please check them

before appearing.

APPEARANCES.

• In-person appearances are mandatory for all motions and applications. The virtual Microsoft

Teams link for Part 16 (on the last page) will be available for emergencies only. Failure to appear on the return date

may result in the motion or application being marked off the calendar or submitted without opposition being

considered.

• If a motion or application is marked off for non-compliance with the Part Rules, a new motion for

the original relief may be filed in accordance with the Part Rules. A motion to restore, renew, or reargue the original

Motion is NOT required UNLESS the non-compliance and resultant marking occur on more than one occasion.

• ALL fully submitted motions will be conferenced/orally argued following the call of the calendar.

ADJOURNMENTS.

• Stipulations regarding pending motions should be e-filed AND sent via email to

4

QSCPart16@nycourts.gov at least 1 business day prior to the calendared date and time.

• Motions may be adjourned on consent provided a written and fully executed stipulation is submitted

to the Part Clerk no later than 1 business day prior to the calendar date and time via email at

QSCPart16@nycourts.gov. Non-compliant stipulations or late requests may be denied, and counsel is responsible

to confirm the status of their adjournment request. Consent adjournments, absent extenuating circumstances and in

compliance with the Rules of Chief Administrative Judge 125.1 re: medical emergency, other exigent circumstance,

or unavailability of the court, shall be limited to 2. Any further request for an adjournment must be made via email

to QSCPart16@nycourts.gov, and are subject to approval by the Judge.

HARD COPY EXHIBITS (FLASH DRIVE/JUMP DRIVE, CD). Exhibits that cannot be filed via NYSCEF,

such as videos, should be submitted to the Court on the Return Date at the conference/oral argument. Flash

drives/jump drives are preferred as opposed to CDs or other formats. Courtesy hard copies of exhibits or papers

filed on NYSCEF are not required.

DISCOVERY MOTIONS. Discovery motions should be made ONLY if the matter has been released

from its assigned Compliance Conference Part. In such an event, the movant is to include evidence of being released,

such as a releasing order, as an exhibit to the motion. Discovery motions are expected to settle/resolve via

stipulation.

SUR-REPLIES & ADDITIONAL FILINGS. The Court will not consider sur-replies or additional papers

filed after submission of the motion unless the parties were granted permission to file.

EFFECT ON DISCOVERY. Parties should proceed with discovery, even if a dispositive motion is

pending. Unless otherwise stated by Court, the filing of a dispositive motion does not automatically stay discovery.

GENERAL REQUIREMENTS.

• All motion papers submitted to the Court shall be incompliance with 22 NYCRR §§202.5 and

202.8, 8a-g. In addition to these requirements, all pages and paragraphs are to be numbered. Failure to comply with

these requirements MAY result in rejection of the non-compliant submission.

• Filing parties are advised to consult Uniform Rules for the State Trial Courts §202.7(f) concerning

notification on emergency applications. Please refer to this link as needed Uniform Rules.

• Filing parties are also advised to check the court’s website for up-to-date information regarding

Orders to Show Cause and Ex Parte Orders, as well as for information regarding the necessary Emergency

Affidavit at Ex Parte.

TRIALS

BE PREPARED. All parties appearing for trial must be familiar with the case, ready, and authorized to

participate in settlement discussions and/or to proceed to trial in accordance with the following scheduling

directives. This includes consideration of the availability of all intended witnesses, including experts.

SCHEDULING. The trial will be conducted on a continuous daily basis until conclusion during regular

operational hours. Tort actions are generally bifurcated, and a trial on damages will immediately follow a verdict in

favor of liability. No adjournments or delays during trial will be accepted absent exigent circumstances.

MOTIONS IN LIMINE. On the first appearance in the Part for trial, any party intending to make a motion

5

in limine shall submit a brief written affirmation setting forth the nature of the application and any supporting

statutory or case law. The affirmation and motion should be filed on NYSCEF as “Trial Documents,” not

filed/sequenced as customary motions are. They must also be sent via email at QSCPart16@nycourts.gov upon

filing. Late motions in limine may be summarily denied for untimeliness.

JURY INSTRUCTIONS & VERDICT SHEET. Proposed jury instructions, in compliance with the most up-

to-date version of the PJIs, and a proposed verdict sheet must be submitted prior to the charge conference.

SUMMARY JURY TRIALS & BENCH TRIALS.

about applications should be submitted via email to QSCPart16@nycourts.gov.

If the application is incomplete or needs corrections, the court will notify the parties through NYSCEF,

email, or regular mail. The parties will be given 45 days to correct the deficiencies. Failure to timely correct,

without good cause, will result in dismissal of the action without prejudice.

SCHEDULING. Hearings will be scheduled by the Court, and the parties will be notified via NYSCEF

or email. Generally, these infant compromise hearings will be conducted virtually.

VIRTUAL PROCEEDINGS/APPEARANCES PROTOCOLS

During virtual proceedings/appearances, the parties should maintain the same decorum that exists

in all in-person court proceedings. Specifically, attorneys and litigants should be punctual, appear in professional

6

attire, appear in a professional setting, minimize distractions and background noise in the environment, be courteous

and respectful when others are speaking, and mute microphones when not in use.

Every effort should be made to appear via video with cameras and audio engaged. Telephonic appearances

shall be limited.

the etrack service for Part 16 cases. To register or login, please visit: etrack login.

REQUEST TO SO-ORDER/SIGN. Do NOT e-file documents you wish for the Court to sign/so-

order. Chambers does not receive notification of anything that is e-filed. Instead, email any such document to the

assigned and appropriate Part.

ALTERNATIVE DISPUTE RESOLUTION

The court strongly encourages all parties to consider Alternative (Appropriate) Dispute Resolution,

including court-sponsored or private mediation, arbitration, conceding liability, and/or establishing high/low

parameters, in resolving their matters. If interested, please notify the court via email to QSCPart16@nycourts.gov

and the court would be happy to engage in a virtual conference to explore the options further. Any questions

regarding ADR may be submitted to the court via the same email. The court MAY order parties to ADR without

request or consent.

Mediation: If court-sponsored mediation is requested an Order of Reference will be issued; if private, the

parties are requested to keep the court appraised of the mediation’s progress and/or results. Parties should also

indicate whether they prefer discovery be stayed or continued during the process.

Arbitration: If the parties are proceeding to arbitration, an email to that effect should be submitted to the

court.
